Habitability

Habitability is the legal standard requiring landlords to maintain rental properties in a condition fit for human occupancy. Failure to meet habitability standards can trigger REAP, rent reduction, or tenant legal claims.

What it means in practice

California's implied warranty of habitability requires functioning plumbing, heating, waterproofing, electrical, and structural integrity, among other elements. Serious violations (infestation, mold, structural hazards) can trigger city code enforcement and tenant remedies including withholding rent or "repair and deduct."

Why it matters for LA multifamily

For LA multifamily sellers, habitability issues are diligence red flags. Unresolved habitability claims can extend into post-close liability. Clean habitability status — no open code violations, no active tenant complaints — materially supports sale pricing.
